“BPA-free” stopped being the right question in 2025

For years “BPA-free” on a label was enough. It no longer is, for a specific reason: when BPA came under pressure, part of the industry substituted BPS and BPAF — structurally similar bisphenols that allowed the same label while raising the same class of concern.

The EU closed that loophole. Regulation (EU) 2024/3190, in force since 20 January 2025, bans BPA together with other hazardous bisphenols — BPS, BPAF, TBBPA and phenolphthalein among them — not only in plastics but in coatings, printing inks, adhesives, silicones and rubber. It amends EU 10/2011 and repeals the older 2018/213.

So the question to ask a supplier is no longer “is it BPA-free”. It is “which resin is it, and can you declare that no bisphenol was used in manufacture”. Those are answerable questions with documents behind them. The first is a marketing phrase.

Which plastics are BPA-free by formulation — and which are not

There is a real difference between a material that never contained bisphenol A and one that contains residual amounts below a detection limit. The second still gets called “BPA-free”.

A commercial tell worth knowing: if a supplier quotes a clear, rigid, glass-like plastic well below Tritan pricing, ask which resin it is by name. The answer is often PC or a PCTG blend. “Food-grade plastic” is not a resin name, and neither is “eco plastic”.

Stainless bottles: the body is not the whole product

A 304 stainless body has no bisphenol chemistry in it whatsoever. That much is trivial. But a flask is not only steel — the lid, the gasket, the straw and any interior lining are separate materials, and that is where a bisphenol can appear if a supplier is not paying attention. Epoxy-type interior coatings are the historical case; that chemistry used BPA.

On our flasks the interior is bare 304 or a ceramic lining, lids are PP or Tritan, seals are food-grade silicone. The Declaration of Compliance covers all components, not just the shell. When you specify a BPA-free stainless bottle, ask the supplier to confirm the lid and the liner specifically.

The decoration is in scope too

This is the part most suppliers miss. Regulation (EU) 2024/3190 reaches beyond the plastic into printing inks, coatings, adhesives and rubber. A bottle can be moulded from compliant Tritan and still fail on the ink or the powder coat.

We decorate in-house by silk screen, UV digital, laser engraving and heat transfer, and the declaration covers the decoration as well as the body. If you are comparing suppliers, ask whether their BPA declaration includes the print. It is a short question with a revealing answer.

Two dates that decide whether your stock is sellable

Under EU 2024/3190 the transitional provisions for repeat-use articles — which is what reusable drinkware is — run as follows:

The practical implication if you are ordering now: a supplier still working from a pre-2025 specification may be selling you inventory whose shelf life is set by regulation rather than by demand. Ask for the Declaration of Compliance before the deposit, not after the container sails.

Frequently asked

Not automatically, and this is the question that separates a careful buyer from a careless one. When BPA came under scrutiny, some suppliers substituted BPS or BPAF — structurally similar bisphenols that let a product be labelled “BPA-free” while raising the same class of concern. The EU closed that gap: Regulation (EU) 2024/3190, in force since 20 January 2025, bans BPA and other hazardous bisphenols including BPS, BPAF and TBBPA in food-contact materials. So the useful question is no longer “is it BPA-free” but “what is it actually made of”. Ours are polypropylene, Eastman Tritan copolyester, food-grade silicone and 304 stainless — none use any bisphenol as a raw material, so there is no substitution question to answer.

By formulation, which is the stronger claim. Polypropylene and Eastman Tritan copolyester do not use bisphenol A as a raw material at all — it is not a case of residual levels sitting below a detection threshold. Food-grade silicone seals and 304 stainless bodies are outside bisphenol chemistry entirely. Compare that with polycarbonate, which is made from BPA: a PC bottle described as BPA-free is describing residue, not composition. If a supplier quotes a clear, rigid, glass-like plastic well below Tritan pricing, ask which resin it is by name.

Four things, and you should expect all of them. A material declaration naming the actual resin, not “food-grade plastic”. A Declaration of Compliance stating BPA was not used in manufacture — required by EU 2024/3190, and it now reaches into coatings, inks, adhesives and rubber, so your decoration is in scope too. Third-party test reports — FDA 21 CFR, LFGB, EC 1935/2004 and EU 10/2011, issued by STQ Testing Services and downloadable. Batch traceability, which is what makes the first three verifiable rather than decorative.
